This User Agreement (“Agreement”) is between you and MeshGrid (“we,” “us,” or “our”) governing your use of the MeshGrid mobile application and related services (the “Service”). By downloading, installing, or using the Service, you agree to this Agreement. If you do not agree, do not use the Service.
You must be able to form a binding contract in your jurisdiction and meet any minimum age required by applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal organizational purposes in accordance with documentation and applicable law.
You agree not to:
Mesh and peer-to-peer features depend on radio conditions, device capabilities, and third-party hardware. We do not guarantee availability, range, latency, or delivery of mesh traffic. You are responsible for evaluating whether the Service meets safety or mission requirements.
Map data and location features may be provided by third parties. Displayed information may be inaccurate or incomplete. Do not rely solely on the Service for navigation in situations where error could cause injury or loss.
The Service may interoperate with third-party accessories, firmware, or platforms. Those are subject to their own terms and policies. We are not responsible for third-party products or services.
We may release updates, including automatic updates through app stores. Some features may change or be discontinued. Continued use after an update constitutes acceptance of the then-current Agreement where permitted by law.
The Service, including software, branding, and content we provide, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted.
Our collection and use of personal information is described in the Privacy Policy, which is incorporated by reference.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50), IF APPLICABLE LAW DOES NOT PERMIT EXCLUSION OF SUCH LIMITS, THOSE LIMITS WILL APPLY TO THE MAXIMUM EXTENT ALLOWED.
You will defend and indemnify us against claims arising from your use of the Service, your content, or your violation of this Agreement, to the extent permitted by law.
We may suspend or terminate access to the Service for violation of this Agreement or for operational or legal reasons. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.
Unless applicable law requires otherwise, this Agreement is governed by the laws of the jurisdiction we designate on meshgrid.org, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue, except where consumer protection law gives you non-waivable rights.
We may modify this Agreement by posting an updated version on this page. Material changes may require additional notice where required by law. Your continued use after the effective date constitutes acceptance.
